Sale and Entry Terms & Conditions 2020
 
The terms and conditions set out below shall constitute a binding contract between Australian Airdisplays Pty Ltd (ABN 73 164 102 146) trading as the Brisbane Airshow, the Brisbane Airshow Director, the Brisbane Airshow Organisers, the Brisbane Airshow Assistants, and any Sponsors (“the Event Holders”) and the individual holding or using a ticket (“Ticket Holder” or “Patron”) in relation to the event known as the Brisbane Airshow or Brisbane Airshow 2020 (“the Event”) to be held at Watts Bridge Memorial Airfield, Brisbane (“the Venue”), from 8am on the 3rd of July 2020 until 5pm on the 5th of July 2020. All terms and conditions set out below (the “Sale and Entry Terms”) are to be read in conjunction with any other Terms and Conditions applicable to the patron.
 
1            Conditions of Entry
1.1        Entry into an Australian Airdisplays Pty Ltd Airshow event is conditional upon the acceptance of these terms and conditions; 
1.2        Entry into and attendance at the Event is in accordance with these Event Terms and any other Event Terms and Conditions viewable at www.brisbaneairshow.com.au, displayed at the Event or communicated by the Event Holders from time to time in any other format. 
2            Valid Ticket
2.1        You must have a valid Event ticket to enter the Venue and Event entertainment precinct.
3            Right of Event Holders to evict Patron
3.1        The Event Holders reserve the right to refuse entry or evict any person from the Venue who does not comply with these Event Terms or who engages in an illegal activity or activity deemed in the Event Holders’ sole discretion to be antisocial, including without limitation, being affected by alcohol or illicit drugs.
3.2        Patrons will be removed from the Venue if, in the opinion of the Event Holders or delegated staff  members, they behave or act in a threatening or inappropriate manner, including without limitation, any aggressive, riotous, abusive, offensive, racist, sexist or insulting actions towards other patrons, Event staff or any other persons working at or attending the Event. Protest and political paraphernalia and banners are not allowed in the Event or at the Venue, and the Event Holders reserve the right to remove any person in possession of or displaying these items.
4            Patrons must follow reasonable directions
4.1        Patrons are required to follow the reasonable directions of the Event Holders and Event staff at all times.
5            Lost, stolen and tickets purchased from other sources than ticket merchant
5.1        Tickets are not refundable and will not be replaced or refunded if lost, stolen or damaged, except as required by law or as otherwise specified by the Event Holders. Damaged or defaced tickets will not be accepted. Do not share your ticket barcode with anyone else or you may be denied entry. Ticket purchased from a source other than the official ticket merchant will not be honored at the Event.
6            Change of program
6.1        The Event Holders reserves the right to change the Event program and vary the Event date or venue at its discretion without prior notification. To the extent permitted by law, the Event Holders are not liable for any loss, injury, damage or compensation, as a result of the Event being cancelled, postponed relocated or changed for whatever reason. 
7            Refunds & Force majeure
7.1        If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Brisbane Airshows Organisers, and which prevents the Brisbane Airshow Organisers from complying with these Terms and Conditions, the Brisbane Airshow Organisers will not be liable for any failure to perform or delay in performing their obligations, and the Brisbane Airshow Organisers reserve the right (subject to any applicable law) to at any time cancel, terminate, modify or suspend any Brisbane Airshow events with or without refund of ticket sales to Patrons.  No ticket refunds or compensation will be made in circumstances where the Event program varies due to the non-appearance of program participants. There will be no refund of any unused portion of an Event Ticket if you are asked or forced to leave the Event for any of the reasons set out in the Event Terms or if you decide not to attend the Event.
8            Resale of tickets
8.1        The sale or attempted re-sale of a ticket by the Ticket Holder (including via on-line auction sites) without the prior consent of the Event Holders is prohibited. If a ticket is sold or used in breach of these Event Terms, the Event Holders retain the right to: cancel the ticket without a refund, refuse entry to or eject the Ticket Holder from the Event and/or commence legal proceedings. Should the Event Holders offer a resale facility this will be the only legitimate way to on-sell any unwanted tickets. Use of tickets for or in conjunction with any advertising, promotion, marketing or competition is strictly prohibited (unless authorised by the Event Holders in writing). 
9            Event name Trademark
9.1        The Event name (and variations) is a trademark of the Event Holders and protected by law. The Event Holders owns all copyright in the Event name, logo, images, tickets or other works and materials associated with the Event, and these cannot be used in any way (including promotions, advertising and ticket giveaways or for any commercial purpose) unless authorised by the Event Holders in writing.
10         Purchasing alcohol
10.1     The Ticket Holder must comply with the law at all times during the Event. Proof of Age identification is required to buy and consume alcohol and may be requested at any time.
11         Intoxication and anti-social behavior
11.1     Excessive drinkers, illegal drug users or Patrons displaying antisocial behavior may be ejected from the Event (at the Event Holders discretion) or be dealt with by police.
12         Illegal drugs
12.1     Possession, sale or use of illegal drugs or illicit substances is strictly prohibited at the Event. Any persons found with illegal drugs or illicit substances in their possession may be removed from the Venue and be subject to Police action.
13         Lost or stolen items
13.1     The Event Holders is not responsible or liable for any unattended, lost or stolen items. Patrons agree to enter the Venue at their own risk and shall be responsible for their own property and personal items.
14         Damage of Event property and grounds
14.1     Patrons must not cause damage to, improperly use or tamper with any public or Venue facility or Event infrastructure or cause any damage to flora and fauna on or surrounding the Venue. Patrons must not remove or attempt to remove any item or object from the Venue or surrounding area. Patrons accept full liability and responsibility for any loss or damage caused in contravention of this clause or these Event Terms. 
15         Prohibited items
15.1     The following items (without limitation) are prohibited and cannot be brought on to the Venue or to the Event: animals (with the exception of registered guide dogs), alcohol, glass, illegal substances, drones, lasers, flares, fireworks, sparklers, flammable items, explosives, BBQs and anything that could be used as a weapon or any other item deemed by the Event Holders or Event staff (in their discretion) to be dangerous, potentially dangerous or offensive material. Ticket Holders and their property may be searched for prohibited items upon entry to, or at any time during, the Event. Ticket Holders found with prohibited items or who refuse to make their clothes, bags, or other possessions available for search by the Event Staff, may be refused entry to the Event, ejected and/or have the prohibited items confiscated. Confiscated items will not be returned, replaced or reimbursed.
16         Food, beverages and alcohol
16.1     No food, beverages or alcohol are allowed to be brought into the Event. There a food and beverage stalls as well as liquor licensed venues within the event where you may purchase food, beverages and alcohol.
17         Tampered tickets
17.1     The Event Holders reserves the right to deny admission to the Event to any person holding a ticket that appears to be tampered with, counterfeited or duplicated. Anyone found on site without a valid Event ticket or accreditation will be deemed to have trespassed, will be evicted from the Event and may be handed over to the Police.
18         Entry at own risk
18.1     Entry to the Event is at the Ticket Holder’s own risk. Without limiting the generality of the foregoing, appropriate footwear and clothing must be worn at all times at the Event. The Event Holders recommends that due to noise levels, ear plugs should be carried/worn by Patrons. To the extent permitted by law, the Event Holders takes no responsibility for any hearing damage or loss caused by excessive noise or any injury caused by the Ticket Holder’s failure to follow the Event Holders’ directions or Event rules.
19         Medical Assistance
19.1     In the event of Patron injury or illness, the Event Holders may at its discretion, and at the cost of the Patron, arrange medical treatment and/or emergency evacuation as deemed essential or necessary for the safety of the Patron (and/or other Patrons at the Event).
20         Emergency
20.1     In the case of an emergency or serious injury, Patrons must follow all official directives of the the Event Holders or Event’s staff and personnel.
21         Jurisdiction of applicable law
21.1     The Terms and Conditions that apply to these Event Terms are governed by the law in the jurisdiction of Queensland. The Event Holders and the Ticket Holder submit to the jurisdiction of the courts of Queensland with respect to any proceedings arising out of or relating to the Event. 
22         Exclusion of contra proferentem rule
22.1     No provision of these Terms and Conditions, or the Privacy Policy, may be construed to the disadvantage of Australian Airdisplays Pty Ltd, Brisbane Airshow, the Brisbane Airshow Director, the Brisbane Airshow Organisers, the Brisbane Airshow Assistances, and any Sponsors merely because the Brisbane Airshow Organisers prepared them.

Event
Brisbane Airshow Event.
Patron
Any person who has a ticket to the Brisbane Airshow.
Brisbane Airshow
Australian Airdisplays Pty Ltd trading as the Brisbane Airshow.
Brisbane Airshow
An area designated for the purpose of conducting Trading Activity or any other area which Brisbane Airshow has License to control, operate or regulate as a Brisbane Airshow or place where Trading Activity may be undertaken. The Brisbane Airshow includes any roadways, car parking and areas of access under the control of Brisbane Airshow for the purpose of operating the Brisbane Airshow.
Brisbane Airshow Director
The Brisbane Airshow person with full responsibility and authority for the governance compliance and operation of the Brisbane Airshow which extends to the management standards of all Brisbane Airshow staff, contractors and suppliers.
Brisbane Airshow Air Boss, Manager Ground Operations or Ground Support Manager
The person nominated and authorised by Brisbane Airshow to manage, operate, regulate and control the Brisbane Airshow on trading days. The authority granted extends to the provision to consent or withhold consent to any legal entity to attend, occupy or undertake Trading Activity or undertaking at the Brisbane Airshow.
Brisbane Airshow Staff
Persons nominated by the Brisbane Airshow to work within the Brisbane Airshow (eg Brisbane Airshow Ground Support Manager, Brisbane Airshow Director, Brisbane Airshow Volunteers, or other persons as nominated).
Venue
Watts Bridge Memorial Airfield, Brisbane.
